In Florida pedestrians typically have the right of way especially if they’re on a sidewalk or they’re in a crosswalk there’s even times where if they’re crossing the street where they’re not at a crosswalk where we could argue that the driver should have been able to see them or appreciate that there’s a chance that pedestrians may cross in that area.
